Terms and Conditions
"TERMS AND CONDITIONS: I have reviewed the estimated cost of the proposed work to be completed on my property. I agree to pay for all work completed by Six Star Plumbing at my request. I am aware of the terms and conditions of this agreement and expressly agree to all the terms contained therein. I understand the above is an estimate and not a guaranteed figure for the completion of work on my home. I understand that Six Star Plumbing will only the work outlined above unless we obtain a further agreement. 1. Warranty: Six Star Plumbing will offer a one-year product and labor warranty for all rough-in plumbing and fixtures provided by us and installed to the manufacturer’s specifications. 2. Limitations of Liability: Customer understand and agrees Six Star Plumbing shall not be liable for any damage caused as a result of existing improper, worn, rusted or defective plumbing, pipe fixtures, wall, flooring, and /or roofing. Customer further understands and agrees Six Star Plumbing shall not be liable for any incidental or consequential damages which result from materials supplied of services rendered. 3. Entire Contract:This agreement replaces and supersedes any and all previous agreements, written or oral, with the respect to the work to be performed by Six Star Plumbing. Should anyone or, or more of the contract provisions be determined illegals ad/or unenforceable, all remaining provisions shall nevertheless remain effective. 4. Amendments: Amendments to this agreement may only be made in writing and signed by Change Order. 5. Warranty of Ownership: Customer does herby represent that they are the owner of the authorized agent of the owner of the real property which Six Star Plumbing will commence work. 6. Force Majeure: Six Star Plumbing shall not be liable under the provisions of this agreement for damages on account of strike, lockouts, accidents, fires, delays in manufacturing, delays of carriers, acts of God, governmental actions, state of war, or any other causes beyond the control of the manufacturer whether or not similar to those enumerated. 7. Mold Release: Six Star Plumbing makes no representation or warranty, express, implied, or otherwise regarding mold, fungi, rust, corrosion or other bacteria or organisms. Six Star Plumbing shall have no duty or responsibility all of which is expressly waived by you or losses, fines, penalties, testing, analysis, monitoring, cleaning, removal, disposal, abatement, decontamination, remediation, repair, replacement, relocation, loss of use of building, or building equipment and systems, or personal injury, sickness or disease associated with mold, fungi, rust, corrosion or other bacteria or organisms. Any implies warranty of workmanlike construction, implied warranty of habitability or any implied warranty of fitness for a particular use hereby waived and disclaimed. INFORMATION ABOUT LICENDED CONTRACTORS Use only licensed contractors. If you file a complaint against a licensed contractor within the legal deadline, the authority will investigate the complaint. If you use an unlicensed contractor, the authority may not be able to help you resolve your complaint. Your only remedy may be civil court, and you may be liable for damages arising out of any injuries to the unlicensed contractor or the unlicensed contractors’ employees. EXCLUSION WAIVER Six Star Plumbing is not responsible for unforeseen circumstances that may prohibit, or delay agreed scope of work. If work scope changes, work will stop. You will be notified immediately wit change order recommendations, At this time, new options will be provided for you to review and approve before proceeding. Note following exclusions-NOT responsible for: -Existing pipe conditions that are deteriorated, disconnected, not bracketed properly to code, or connections/fitting that were installed improperly by any person prior to six Star Plumbing. -Existing fixtures, shut off valves, or boiler drains that are not working properly. -Preexisting electrical conditions or electrical grounding. -Ground conditions that include: unmarked utilities public or private, underground objects preventing work, etc. -Patching dry wall, tile, floors, ceiling, or walls that need to be accessed in order to complete scope of work. -Wear and tear on installation of new fixtures or plumbing due to water pressure above 80psi -Any person tampering with work performed by Six Star Plumbing will negate warranty offered. Payments to be made of as follows: -50% due at the start of the job -25% due at completion of rough-in inspection -25% due at completion and final inspection
